These Terms of Service (“Terms”) govern your access to and use of the experimental API services (“Services”) provided by useapi.net (“we,” “us,” or “our”), a company based in New Mexico, USA. By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these terms, do not use the Services.

Your use of the Services is also governed by our Privacy Policy, which is included below these terms.

Experimental Nature & Disclaimer of Warranties

You acknowledge the Services are experimental, provided “as is” and “as available,” and may change, be suspended, or terminate without notice.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Affiliation & Third-Party Services

Useapi.net is not affiliated with, endorsed by, or in any way officially connected with Discord, Midjourney, Google, Mureka, Runway, MiniMax, Kling AI, TemPolor, LTX Studio, Pika.art, PixVerse.AI, Picsi.ai, or any of their subsidiaries or affiliates.

We provide an automation tool that interacts with these services on your behalf. We do not sell, resell, or license access to these Third-Party Services. You must have your own valid account with them.

Your use of any Third-Party Service via our experimental API is subject to that service’s own terms and policies. You are solely responsible for reviewing and complying with them. A violation of a Third-Party Service’s terms constitutes a violation of these Terms.

User Credentials & Authorized Agent Status

By providing login credentials, session tokens, cookies, or other authentication data (“Credentials”) to useapi.net, you explicitly appoint useapi.net as your Authorized Agent. You grant us limited power of attorney to access third-party platforms on your behalf solely to execute the automation requests you initiate.

You represent and warrant that you are the legal owner of any third-party account you connect to our Services, or that you have explicit written permission from the account owner to grant us access.

You acknowledge that using automation tools to interact with third-party services (such as Discord, Midjourney, etc.) may violate their Terms of Service. You assume all risk associated with such usage, including but not limited to account bans, suspensions, or legal action by those third parties. Useapi.net is not responsible for any account termination resulting from your use of our Services.

Acceptable Use Policy

You agree not to use the Services to:

(a) Engage in any activity that is illegal under local, state, national, or international law. (b) Transmit or generate any content that is unlawful, harassing, defamatory, hateful, fraudulent, or obscene. (c) Violate the terms of service of any Third-Party Service. (d) Infringe upon the intellectual property rights, privacy rights, or other rights of any third party. (e) Attempt to disrupt, overload, or compromise the integrity or security of our systems or the systems of any third party. (f) Reverse-engineer, decompile, or otherwise attempt to discover the source code of the Services.

We are not obligated to monitor your use of the Services, but we reserve the right to investigate and terminate your access for any violation of this policy, with or without notice.

Payments and Fees

If you subscribe to a paid tier of our Services, you agree to pay the fees specified. All payments are processed through our third-party payment processors. By providing payment information, you agree to payment processors terms and privacy policy. We do not store your full credit card information. All fees are non-refundable unless otherwise required by law.

Intellectual Property

You retain all rights to the input (e.g., prompts) you provide to the Services. The ownership of any output generated by the Services is governed by the terms of the specific Third-Party Service that created it. We make no claim of ownership and grant no rights to the generated output.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, USEAPI.NET AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, RESULTING FROM YOUR USE OF THE SERVICES.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE TOTAL AMOUNT YOU PAID US IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to defend, indemnify, and hold harmless useapi.net, its affiliates, licensors, and service providers, and its and their respective officers, managers, members, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to:

(a) Your violation of these Terms or the Terms of Service of any Third-Party Service; (b) Your use of the Services, including any use of the API’s content, services, and products other than as expressly authorized in these Terms; (c) Any claim by a third party (including platforms like Discord or Midjourney) alleging that your use of our Services violated their rights or disrupted their operations.

Termination

We reserve the right to suspend or terminate your access to the Services at any time, for any reason, including for a violation of these Terms. You may stop using the Services at any time.

Dispute Resolution: Binding Arbitration & Class Action Waiver

1. Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration in Santa Fe, New Mexico, before one arbitrator. Judgment on the award may be entered in any court having jurisdiction.

2. Class Action Waiver: YOU AND USEAPI.NET AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and useapi.net agree otherwise, the arbitrator may not consolidate more than one person’s claims with your claims and may not otherwise preside over any form of a representative or class proceeding.

Governing Law and Jurisdiction

These Terms shall be governed by the laws of the State of New Mexico, USA, without regard to its conflict of law principles. You agree that any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in New Mexico.

General Provisions

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. These Terms constitute the entire agreement between you and useapi.net regarding the Services. We may modify these Terms at any time by posting the revised version on our website.

This Privacy Policy describes how useapi.net (“we,” “us,” or “our”) collects, uses, and shares information about you when you use our experimental API services (“Services”).

- API Usage Data: We log the API requests you make, which may include the prompts you submit, to operate and improve the Services.
Information from Third Parties:
- Payment Information: We use third-party payment processors for payment processing. When you make a payment, they collects your payment information directly. We do not store your full credit card number but may have access to billing details such as your billing address, the last four digits of your card, and transaction history, which we use for accounting and support.

How We Use Your Information

However, you acknowledge that no method of transmission over the Internet or method of electronic storage is 100% secure. We store and process your Credentials to facilitate the automation services you request. By providing these Credentials, you acknowledge the inherent risk of transmitting and storing sensitive data online and agree that useapi.net shall not be liable for any breach of this data unless caused by our willful misconduct.

Exclusion of Liability: To the fullest extent permitted by law, useapi.net and its Managers, Members, and officers shall not be liable for any unauthorized access to, or use of, your Credentials or third-party accounts, resulting from: (a) hacking or malicious attacks on our systems that circumvent reasonable security measures; (b) your failure to secure your own API keys or passwords; or (c) the compromise of your data on third-party platforms.

Refund Policy

As a general rule, all fees paid for the Services are non-refundable.

However, we may consider providing a refund on a case-by-case basis under specific circumstances. A refund may be issued if you are demonstrably unable to set up or use the Services due to technical issues on our end within the first fourteen (14) days of your initial purchase.

To request a refund, you must contact our support team with a detailed explanation of the problem. All refund requests are subject to our review, and we reserve the sole discretion to approve or deny any request. Refunds will not be granted for reasons such as a change of mind or underutilization of the Services.
